Terms of Service
1. Acceptance of Terms
By creating an account or using Hayzr, you agree to these Terms of Service. If you're using Hayzr on behalf of a business, you're agreeing on that business's behalf and confirming you have authority to do so.
2. Description of Service
Hayzr provides tools to build landing pages, manage bookings and appointments, and optionally sync with external calendar providers (Google, Microsoft, Apple). Features may change, be added, or be removed at our discretion.
3. Account Registration
You must provide accurate information when creating an account and are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use.
4. Subscription, Billing & Cancellation
Paid plans are billed on a recurring basis (monthly/annual, as selected) until cancelled. Payments are processed through Fonepay, Khalti, and/or eSewa; Hayzr does not store your wallet PIN, MPIN, or banking credentials. Fees are non-refundable except as required by law or explicitly stated otherwise. You can cancel anytime; cancellation takes effect at the end of the current billing period. We may change pricing with advance notice; continued use after a price change constitutes acceptance.
5. Payments Between You and Your Clients
If you accept payments from your clients through Hayzr's booking flow via Fonepay, Khalti, or eSewa: you are responsible for providing accurate pricing and for any tax obligations (e.g. VAT) tied to your services. Settlement timing, transaction fees, and dispute/chargeback handling are governed by the respective payment gateway's own terms and by Nepal Rastra Bank's Payment Systems-Related Unified Directives. Hayzr is not a payment aggregator or licensed financial institution - we integrate with these licensed providers but are not responsible for delays, holds, or failures on their end. Refunds to your clients are your responsibility as the business owner, subject to the payment gateway's refund mechanics.
6. Acceptable Use
You agree not to use Hayzr to: violate any law or third-party right; send spam, misleading, or fraudulent booking/newsletter content; upload malicious code or attempt to breach Hayzr's security; scrape, resell, or misuse the Service beyond its intended purpose; or impersonate another person or business. We reserve the right to suspend or terminate accounts that violate this section.
7. Calendar Integration & Bookings
When you connect an external calendar (Google, Outlook, Apple, etc.), you authorize Hayzr to read availability and create/update/delete events as described in our Privacy Policy. We are not responsible for outages, API changes, or data issues caused by the third-party calendar provider. You're responsible for reviewing synced events for accuracy; Hayzr is not liable for scheduling conflicts arising from delayed sync, provider downtime, or user error. Hayzr is a platform that facilitates scheduling between you (the business) and your clients. We are not a party to the underlying service agreement, appointment, or transaction between you and your clients, and we are not responsible for no-shows, cancellations, disputes, the quality or legality of services you provide, or refunds owed by you to your clients.
8. Intellectual Property & Termination
Hayzr and its original content, features, and functionality are owned by Hayzr and protected by copyright, trademark, and other laws. You retain ownership of the content you upload (landing page copy, images, branding) but grant us a license to host, display, and process it as needed to operate the Service. We may suspend or terminate your account for violation of these Terms, non-payment, or at our discretion with reasonable notice. You may terminate your account at any time via Settings or by contacting support. Upon termination, your right to use the Service ceases; certain data may be retained per our Privacy Policy and applicable law.
9. Disclaimers & Limitation of Liability
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the Service will be uninterrupted, error-free, or fully compatible with every third-party calendar provider at all times. To the maximum extent permitted by law, Hayzr and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid to Hayzr in the 12 months preceding the claim.
10. Indemnification & Governing Law
You agree to indemnify and hold harmless Hayzr from any claims, damages, or expenses arising from your use of the Service, your content, your violation of these Terms, or your relationship with your clients. These Terms are governed by the laws of Nepal, including the Electronic Transactions Act, 2063 (2008), the Individual Privacy Act, 2075 (2018), and the E-Commerce Act, 2081 (2025), without regard to conflict-of-law principles. Any disputes will be resolved in the courts of Nepal with jurisdiction over Kathmandu.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or in-app notice, and continued use after changes take effect constitutes acceptance.
